Feiner set to appeal Edgemont incorporation ruling, as legal fees rise to $400k in third round of decade-long voting rights battle

It’s the third time in nine years that a state Supreme Court justice has ordered a vote on incorporation after Feiner ruled that the proponents had failed to adhere to state law in their petition seeking a vote. But in the two previous attempts in 2017 and 2019, a state appeals panel later sided with Feiner, with a vote yet to take place....
Greenburgh taxpayers will foot the bill, which Edgemont incorporation advocates say has reached at least $1 million over past decade. The Greenburgh Town Board on March 11 authorized $50,000 for the review and evaluation of the petition by Jerry Goldfeder, a noted New York election law attorney at the firm Cozen O’Connor. That raises the taxpayer tab to $400,000 in the third round of the incorporation saga, with the town government intent on stopping Edgemont voters from casting ballots on incorporation....
Barry McGoey, an Ardsley attorney and former Yonkers Firefighters union leader, will face Feiner in a June 23 Democratic primary. While not taking a position on incorporation, he said “there seems to be a basis for appeal on several respects.” He added that Edgemont’s protracted fight to create the new village government is a symptom of growing concerns over Feiner’s 34-year tenure as town supervisor.
“Since the last village was incorporated in 1910, no area in Greenburgh has felt a need to incorporate,” said McGoey. “It’s a symptom of Feiner’s 34-year reign. People feel unheard.”
